Thanks for the info, Jeannika and DR, after the OJ outcome I was wondering what prior bad acts could be excluded.

"Ray has attracted critics."

Blair Warren, a marketer, put it in one sentence:

"People will do anything for those who encourage their dreams, justify their failures,
allay their fears, confirm their suspicions and help them throw rocks at their
enemies."

Finding the positives in such appalling episodes as the Holocaust or Dafur is literally a litmus test--or a conmans filter just like Byron Katies turnarounds--if you accept the turnaround the conman knows he has you under control and ripe for picking, confused and with all moral standards shattered.

Since ABC and NBC have aired programs about the Sedona tragedy, there's increasing interest by people who knew the Rays in the Tulsa area. I was recently contacted by some of those people through the Oklahoma "grapevine".JAR's claims about growing up "poor" are definitely not true. The family still owns properties in Tulsa County.*

James was considered "not very bright" and seen as incapable of original ideas; just an imitator of his father's preaching/scamming. He was a bully, arrogant and hateful, especially toward poor people. He's reported to have expressed a desire to be "better and bigger" than other guys and for this reason, started injecting steroids as a young man. On Mind Games, the statement that he only uses steroids 'for a medical condition" is just ludicrous. How can his PR/defense team expect anyone to believe his steroids are for medical reasons, when it's documented JAR's been using them for at least 30 years? [www.fictionwise.com] [poprockcandymountain.com]

Not only was JAR a competitive bodybuilder, apparently his first wife, Mariellen, was also. [www.musclememory.com] It looks like after their divorce and home foreclosure in 1986,** Ray moved to Kansas City, where he dated another bodybuilder, and continued to compete. Read 'Richard Brown' [saltydroid.info]

Doesn't long term steroid usage cause hormonal and muscular complications? Ray physically deflated during his 23-day jail stay, but a couple of weeks after his release,he pumped up quickly. In his current youtube videos, it's obvious he did things to "restore" himself with cosmetic work and poorly-applied makeup. He's obsessed with his image and appearance, but I believe it will work against him at trial. The jury pool in Yavapai County will be completely turned off by his narcissism and its obvious dangerous repercussions.

The pre-trial dance of horse-trading has begun. It seems that James Ray's lawyers are producing further reams of white(wash)papers rather than a straightforward answer to the charges:

It's interesting to watch all the legal gyrations of James Arthur Ray's pack of lawyers. It's obvious Mr Ray wants to world to know just how special he is.

James Arthur Ray is so very special that:

A. Arizona Rules of Criminal Procedure do not apply to him.
Specifically Rule 35.1 Motions: form, content and rights of reply

These rules were created to produce precise, but concise, (translation, direct and to the point) pleadings in criminal cases ... and prevent an already overburdened court system from being bogged down by reams of redundant and/or unnecessary verbiage. The rules are specific as to the size of paper allowed (8.5 x 11) and the number of pages (10, NOT including attachments attachments) ... a reply (including supporting memorandum) cannot exceed 5 pages (again not including attachments).

On June 29th Jame's Arthur Ray's people filed two motions.

BOTH motions were 17 pages in length (almost twice the limit, but then he's twice as special). To reinforce just how very special James is, his Los Angeles Pro Hac Vice attorney Truc T. Do took it upon himself to attach a 7 page Declaration supporting James Arthur Ray's motion to each of his motions (talk about needlessly redundant verbiage!). Making the grand total page count for each motion a whopping 21 pages.

1. Motion to Compel Disclosure / Request for Sanctions

A motion to compel asks the court to order either the opposing party or a third party to take some action. This sort of motion most commonly deals with discovery disputes, when a party who has propounded discovery to either the opposing party or a third party believes that the discovery responses are insufficient. The motion to compel is used to ask the court to order the non-complying party to produce the documentation or information requested, and/or to sanction the non-complying party for their failure to comply with the discovery requests.

2. Motion to Change Place of Trial

James Arthur Ray doesn't seem capable of abiding by anyone's rules but his own. From what I've seen by his various motions, if he can't get things his way he makes waves. A few months back James attempted to have the current Judge removed from his case by accusing him of [accidental] misconduct. A hearing was held and his request denied.

Now that he's stuck with a conservative Judge he DOES NOT want ... James wants his trial moved to an other location. The inference being ... he's now so infamous in Yavapai (translation: special in a BAD way) it would be impossible for him to get a fair trial there. So far Yavapai's struck each of these motions.

B. He requires no less than three (count them) Los Angeles based "Pro Hac Vice" attorneys along with an Arizona based attorney.
Click here if you want to read Arizona's regulations pertaining to Pro Hac Vice attorneys

I can't help wondering why a man who's as innocent as James Arthur Ray keeps professing he is - needs that much fire power. Also, if he's as broke as he states he is, how is he able to afford these many lawyers and their fees ... let alone the filing fees for all those motions?

If these lawyers are as good as they want us to think they are, why in the heck don't they file motions properly THE FIRST TIME??? Each time they file improperly, (add too many pages, and/or neglect to follow state rules) their motions are denied ... and need to be refiled. If this keeps up ... James Arthur Ray is going to run out of cash very quickly ... if he isn't already.

This entire case (and how it's being handled by James Arthur Ray and his legal team) is too strange. It's obvious that he and his legal team are living in an alternate universe (revolving around James Arthur Ray). It should be interesting to see if his lawyers will be able to condense his motions down to 10 pages or less and refile them.

I for one will be happy once the trial gets going. I'm tired of James Arthur Ray's inane Twittering, strange videos, and the never ending stream of bullshit he generates everywhere he goes. That there are still people following his teachings blows my mind. God willing he'll end up behind bars and no more people will be hurt, maimed or killed by him again.

@Jeannika Excellent research!

It is indeed shocking that he can have this endless supply of lawyer money. What happened to being broke? I saw on twitter back in June, where Ray described "flying to the mountains". A few days ago, someone tweeted him asking if he paid the $50,000 to see Genpo Roshi,a "Zen master". When I googled, I saw Roshi indeed held a retreat that week, and it was located in Utah. Is it far-fetched to wonder if the visit were actually a business meeting and now Ray's tweeting Zen quotes to make it appear he went for spiritual guidance?

This came out today [www.naztoday.com] I can't imagine the judge allowing exclusion.

@Stoic Thanks for the link you posted at SDs to Macumazahn here on rickross. It's helped me understand the cognitive dissonance my daughter is experiencing and to see the shame and guilt that her ex uses to control her.

James Arthur Ray's Twisted Logic and other Mystical Lies

James Arthur Ray would have us believe that because the onset of hypothermia and its symptoms can vary, it would be almost impossible to prove hyperthermia is what caused people to sicken and die during the sweat lodge. He bases his belief on a small snipet of the medical examiner’s testimony (regarding the eventual causes of James Shore, Kirby Brown and Liz Neuman deaths). Not surprisingly leaving out contributing causes which would obviously go against the theory he wants to present.

This wacked-out nit-picky logic is kind’a like saying a person who was shot in the head and died from the resulting brain hemorrhage … wasn’t killed by the person who shot them. Not surpisingly in this logic states that the guy holding the gun isn’t responsible for anyone’s death. (1) THE GUN DID IT, so the people who manufactured the gun were at fault (2) Lots of people survive gunshot wounds, (3) I’ve shot lots of people and no one’s died before (4) this person must have had a preexisting condition which caused them to die.

What James Arthur Ray Would have Us Think

He's pure as the driven snow, and completely innocent.

James would like people to believe that Mr Pfankuch didn’t suffer hyperthermia at a prior sweat lodge. He simply “fainted”. End of story … just how he fainted is another story … and something James’ people have thus far avoided getting into. (I wonder why?)

Because Mr Pfankuch had a slightly sub normal temperature at the E.R., (long after he arrived) James wants people to believe there’s no way he have suffered from hyperthermia at the sweat lodge. The fact that Mr Pfankuch was allowed to take a [long cool] shower to clean off the sand he was covered in - is irrelevant.

James keeps attempting to twist the definition of hypothermia and it’s symptoms to fit his own convenient misconceptions. A whole lot more than simple hypothermia contributed to the sickening and deaths of people in Sedona.

Technically speaking, Hyperthermia sets in ... anytime someone presents with a core body temperature greater than 100–101 °F. (NOTE: This change should occur WITHOUT a change in body temperature set-point.) Set points represent the norms each of us have for various body systems including blood-pressure, heart rate, weight, metabolism and body temperature.

While set-point norms can vary quite a bit from person to person, should they vary too much in any direction people quickly sicken or die. Body temperatures above 104 °F can be life threatening. The process used to control and maintain all these bodily functions is called homeostasis.

Human homeostasis refers to our body's ability to regulate its inner environment. This helps keep the body functioning smoothly regardless of any changes or fluctuations in environment and/or weather. An inability to maintain homeostasis (homeostatic imbalance) may lead to death or a disease.

James enforced a three day no food, NO WATER, fast, prior to the sweat lodge. Even in normal temperatures, people have been known to die after as little as three days without water!!! The elevation in Sedona is 4500 feet, well above the norm for many people. Last year (during the Spiritual Warrior event) the humidity vacillated between 30-20% (LOW). The combination of high winds (up to 50mph), low humidity and Sedona's high elevation dramatically speed up the process of dehydration.

So each and every PAYING sweat lodge participant was suffering from various degrees of sleep deprivation, dehydration and exposure. (I say paying, because it appears James Arthur Ray and his staff were allowed to eat, drink and sleep. Oh and wear warm clothing during the frigid Sedona nights.) Participants bothered by the cold and rain WERE NOT allowed to wear their own warm clothing and had to pay around 300 dollars for an Andean poncho.

For the record, you can’t erase three days of dehydration in a matter of hours – by simply drinking water. Drink more than 32 ounces at a time ... and you can die from water toxicity. Also, after three days of no food or water your stomach shrinks considerably. So if you drink or eat too quickly, you’re going to vomit. The ONLY way you can quickly rehydrate a body suffering from three days of dehydration is intravenously. So these poor folks were basically toast even before entering the sweat lodge.

Obviously the odds are high that James Shore, Kirby Brown and Liz Neuman WOULD NOT have died from multiple organ failure (ultimate cause of death) had they NOT attended the sweat lodge. Most likely no one would have gotten as sick during and after either … had they been adequately hydrated prior to the event. However the sweat lodge temperatures were so damned extreme, no amount of hydration could have prevented inuries. It’s miraculous more people didn’t die that day. At temperatures as high as they were at the Sedona sweat lodge ... people were bound to get sick or die ... regardless of how hydrated they were.

Hyperthermia Symptoms

The dehydration and heat stroke can produce nausea, vomiting, headaches, and low blood pressure. This can lead to fainting or dizziness, especially if the person stands suddenly.

In the case of severe heat stroke, the person may become confused or hostile, and may seem intoxicated. Heart rate and breathing increases as blood pressure drops and the heart attempts to supply enough oxygen to the body. The decrease in blood pressure eventually causes blood vessels to contract, resulting in a pale or bluish skin color in advanced cases of heat stroke.

James Shore, Kirby Brown and Liz Neuman DID NOT die happy peaceful deaths. They DID NOT choose to die ... or NOT RETURN ... they fought to live ... and lost. All while under the SO CALLED care and administration of someone who should have known better.

Hyperthermia Basics

When your body temperature is too high, it speeds up the metabolism (AKA metabolic rate) of different tissues and body systems (skin, lungs, liver, cardiovascular system, brain, etc.). If this state is allowed to continue unchecked … the body begins shutting down and death occurs.

Once the blood is too warm you quickly become short of breath, your heart rate becomes fast and irregular, and your blood pressure drops dangerously low. Your central nervous system is dramatically affected by hyperthermia (and dehydration), causing confusion, disorientation and delirium … eventually convulsions set in.

There isn’t a person on the planet who can survive temperatures of 113 °F or above for very long, no matter how powerful their thought processes. Heat rigor (when the muscles in the body coagulate after prolonged exposure to extreme heat) sets in at around 120 °F, at which point you quickly die.

Almost all our body heat is generated in within our deep organs, (brain, heart, liver, and during muscle contraction). Prolonged exposure to high temperatures, stress these organs (along with ALL body systems), and places us in grave danger of injury or death.

There are four ways the body loses heat

1. Convection
2. Conduction
3. Radiation
4. Evaporation.

If your skin temperature is hotter than your surroundings, the body loses heat by radiation and conduction.

If the temperature of your surroundings is greater than the temperature of your skin, the body gains heat by radiation and conduction. At this point the ONLY way your body can rid itself of heat is by evaporation.

During the sweat lodge, not only was the air temperature way too hot, the humidity was a staggering 100%, which rendered people unable to breath or sweat (evaporation) and caused their internal body temperature to rise even more quickly.

LIES UPON LIES

On March 16, 2010, That State of Arizona, Yavapai County – ordered the redaction of the autopsy reports of Shore, Kirby Brown and Liz Neuman. At which time the complete autopsy reports were sealed. The court ordered that these files were not to be opened or reviewed unless there is further order.

On June 29, 2010 James Arthur Ray’s defense filed a pleading entitled “Declaration of Truc T. Do in Support of Defendant James Arthur Ray’s” Motion to Change Place of Trial” Attached to this pleading, (in violation of the Court’s order sealing the autopsy reports) are Exhibits 66, 67 and 68, complete and unredacted copies of the autopsy reports!

Truc T. Do states the release of these reports during the trial would only inflame and turn people against James Arthur Ray, and make it impossible for him to have a fair trial in Yavapai County.

One begs to ask … if these files are as damning as Truc T. Do would have us believewhy in God’s Green earth would he attach them to an easily accessible public document for all to see? The answer is he wouldn’t have … unless he had ulterior motives. It’s obvious this was a blatant attempt to cause further pain to the families and the survivors. Further proof that neither James Arthur Ray or his defense team give a damn about ANY the survivors, victims or their families.

Kudos to Yavapai County for catching this error and quickly filing an EMERGENCY MOTION TO SEAL.

Closing Notes

James Arthur Ray’s Spiritual Warrior Retreats (along with most of our other retreats) were train wrecks waiting to happen. The fact that more people weren’t hurt or killed during these events is miraculous, and has NOTHING to do with ANYTHING enlightening James said or did during these events.

I find it interesting that James Arthur Ray is fighting so hard to keep ALL prior injuries from being entered as evidence. I would venture to guess that many more people were injured than the world will ever know. Lord knows what kept them from coming forward, (embarrassment, denial or fear?). I wouldn’t be surprised if a number of these people start coming forward during the trial.

So for now we all watch and listen James Arthur Ray’s current train wreck of a life. He says he’s innocent (yeah right), has never committed any crimes (numerous court papers prove otherwise), has never stolen from anyone (wanna bet), the sweat lodge deaths and injuries were ALL accidental (no one’s THAT stupid), and he’ll soon be vindicated (God I hope not).

OOPS F***ed up Again
James Arthur Ray Apologizes ... Sort'a

Quote
[color=#FF0000
JAMES ARTHUR RAY'S RESPONSE TO STATE'S MOTION TO SEAL EXHIBITS[/color]]Defendant James Arthur Ray, by and through his attorneys of record, joins the State's motion to seal Exhibits 66, 67 and 68, attached to the Declaration of Truc T. Do in Support of Motion to Change Place of Trial and Motion to Compel Disclosure, previously filed on June 29, 2010, in part. The exhibits were inadvertently submitted in its entirety. [I don't think so - Do YOU?] Mr. Ray withdraws all pages of Exhibits 66, 67, and 68 except for the first page and final summary and opinion paragraph of autopsy reports.
Isn't it amazing James Arthur Ray was capable of expressing everything that needed saying in a single paragraph? Wow! Then again apologies don't seem to be one of his strong points. Why apologize for royally screwing up when you can say it was an accident [Gee whiz I never meant for anyone to see those nasty old autopsy photos] ... and obviously NOT your fault.

All kidding aside, what a stupid (on WAY too many levels) and EXPENSIVE mistake.

James Arthur Ray's legal bullshit (delusion based white papers, overstated motions and appeals) slows down the entire discovery process ... and forces the courts to spend valuable time identifying legal issues and winnowing through cited references.

You should read through his motions and appeals ... they're long, wordy and contain multiple [irrelevant] redundancies and errors. (But then that's just my lowly opinion.) While they're interesting for ME to read, I'm disabled/retired with LOTS of free time. I'm sure the busy folks in the Yavapai County Clerk's office DO NOT appreciate all the extra work created by all his legal paperwork.

Jeannika, Have you thought about a career in legal? There's work you can do from home, even get your studies online.

Today the cook hired by JAR at the Sedona retreat has posted at the saltydroid. He says Ray ate lobster and other fine foods and wines while starving participants then feeding them hot dogs, beans and corn. He pretended to pass on food but had secretly already dined. And his reaction to the 3 unconscious people, "Let them enjoy the experience." There were many syringes in his wastebasket.

Is it typical that cult leaders deprive their followers? I read that David Koresh was the only one with carpeting, heating and air conditioning in his sleeping quarters. The others had cement floors, metal bunk beds and no temperature controls.

Jeand,

Is it typical that cult leaders deprive their followers?

From the cults leaders point of veiw, the entire purpose of the cult and followers is to bolster the leaders own notion that he is a special and superior being. The content of the belief is immaterial, the point is the elevation of the leader as being better than the hoi-polloi in some mysterious way.
An easy way to do that is to make the followers 'less than', in need of teaching, substandard and lacking in some way, always short on understanding the glorious special complexity of the leader.
Eventually the follower is deprived of his selfhood and individuality.

Most cult leaders achieve this through many subtle and complex power plays, controlling the food of the followers is just one such powerplay. Living in luxury and plenty (on the followers money and labour) while the followers have little is another way to underscore the vast difference between the 'exalted leader' and the 'disposable others' who serve him.

If you want a scary and very entertaining look at what steriod use can do to a person, please get and read Sam Fussell's memoir, Muscle: Confessions of an Unlikely Body Builder.

He became obsessed with body-building and got to a point where he used steriods and competed in contests. Did this in the 1980s, so that would put us in the time frame when JR was in the 'builder' scene.

Anyone curious about the background Arnold Schwarzteneggar came from should also read this book.

Be careful at if you begin to read this at bedtime--its one of those books that is hard to put down.
