Do you really think the moderate Muslims can fight this alone?
Why aren't feminist organizations vociferously speaking out against Islamic laws against women?
Chivalry is considered a Western construct and therefore anti-Islamic?
Islamic scholars are having a hard time defeating his logic which is based on the Koran.

It doesn't make you a racist or a bigot to think critically about the implications of Sharia Law in your neighborhood. Like any cult, they will cry out "pluralism" and "religious freedom" to practice their crimes against humanity in the name of religion.

Misyar is a form of marriage that allows couples to live separately but come together for sexual relations. For the women who accept it – spinsters, divorcees and widows – it's a something-is-better-than-nothing option, though they waive almost all the rights that a normal Muslim marriage entitles them to.

For men it offers an opportunity for a bit of fun on the side, in secret, and at a huge discount.

Reasons for popularity of misyar include the high cost of marriage – the dowry, several dinners, parties, decoration of a flat or a villa and the honeymoon. All this may set back the groom by several hundred thousand riyals.

Misyar for cash-strapped men is a boon.

Hamdan, a Saudi colleague of mine back in Jeddah – distraught and depressed after the break-up of his first marriage – entered into a succession of misyar marriages. None lasted for more than six months. He confided that he had hoped to find a compatible partner for a permanent relationship but it didn't work out. He also said that misyar wives are crafty and inclined to extract money and gifts. In his words: misyar marriages are not cost-effective. The colleague is now married again – in a normal marriage – and hopes to live happily ever after.

Thanks to Bluetooth technology, friendly websites and an abundance of furnished apartments in major cities like Riyadh and Jeddah, there are tales of misyar wives who have clandestinely entered into more than one misyar contract. These enlightened ladies say misyar husbands never tell their full-time wives about their relationships so why can't misyar wives have similar arrangements? Clerics view this as a dangerous trend.

Website ads for misyar marriages often reveal the immaturity and desperation of those looking for partners:


• Young man, 21, excellent monthly income, seeks marriage as soon as possible to single girls up to 70 kgs, living in Jeddah.
• Saudi clerk, 38, from a well-known family, seeks pretty, white, delicate, businesswoman or clerk for misyar marriage. With Allah's help, if things work out, the marriage will be official.
• Accountant, 30, seeks misyar marriage with Saudi woman. Age, experience, number of children, widow or single or divorced unimportant. What is important is her ability to satisfy the needs of a man who desires things permitted by religion (halal).

Misyar is popular in the kingdom because in a society where extramarital and premarital sex is a cardinal sin it legitimises sexual relations outside the framework of conventional marriage. It was legalised through a fatwa (religious edict) issued by late Sheikh Abdulaziz bin Baz, then the chief mufti of Saudi Arabia. 'Urfi (unofficial marriage) in Egypt and muta'h (temporary marriage) in Iran are variations on the same idea.

The Egyptian Centre for Women's Rights says misyar is an insult to both men and women and a sanction for the trafficking of women. Clerical opinions vary.

Yusuf al-Qaradawi, the Qatar-based Egyptian scholar, says:


Misyar should be viewed as a form of legal relationship beween man and woman regardless of any description attached to it ... But I do have to make it clear that the aforementioined statement does not make me a protagonist of misyar marriage ... There is no doubt that such marriage may be somehow socially unacceptable, but there is a big difference between what is Islamically valid and what is socially acceptable.

Emirates-based scholar Sheikh Ahmad al-Kubaisi says that while misyar marriage is correct Islamically, it also compromises some values. Al-Kubaisi believes that misyar can solve the high rate of spinsterhood in the Arab countries:


The only difference (with a normal marriage) is that the woman abandons voluntarily her right to housing and support money. There is nothing wrong in relinquishing one's own rights.

In 2006, after years of deliberation and a fair degree of dissent, the Mecca-based Muslim World League's constituent body, the Islamic Jurisprudence Council ruled that misyar marriage was legal. Samirah, a Saudi media personality (not her real name) described the decision as unfortunate. She thought the jurists had a difficult problem to resolve but this wasn't the best way out. Rula Dashti, head of the Kuwaiti Economic Society describes misyar as an arrangement that destroys the fundamentals of family. Ghada Jamshir, a Bahraini activist who lobbies for reduction of clerical influence in family affairs, thinks liberals should object to misyar marriages.

To misyar or not to misyar? Saudi society is certainly confused on this issue, as is apparent from the following conversation reported in a Saudi newspaper:


Years ago, I overheard one of my son's friends talking about marriage and girls and he asked: 'Why buy a cow when milk is free?' They were talking about loose girls and there not being any meed for marriage with them around," said a university professor.

With misyar marriage, haven't we just legalised the 'why-buy-the-milk-when-the-cow-is-free' syndrome? And we are supposed to be civilised?

The proliferation of "temporary marriages" shows how Muslims in Britain are using Islamic Sharia Law to establish parallel forms of marriage that are otherwise illegal.

An increasing number of Muslims in Britain are reviving the Islamic practice of temporary marriage, according to a recent BBC television documentary focusing on the "taboo subject."

Temporary marriage -- a euphemism for religiously sanctioned prostitution -- is an Islamic custom that unites a man and an unmarried woman as "husband and wife" for a limited period of time (sometimes for less than half an hour).

The proliferation of temporary marriages -- combined with the spike in polygamous marriages -- shows how Muslims in Britain are using Islamic Sharia law with impunity to establish parallel forms of "marriage" that are otherwise illegal for non-Muslims in the country.

The 30-minute documentary examining temporary marriages in Britain is called "Married for a Minute" and first aired on the BBC on May 13.

Called Nikah al-Mutah ("short-term marriage") in Arabic, the union consists of a verbal or written contract in which both parties agree to the length of time and conditions for the marriage. The union can last for a few minutes or a few years and when the contract ends so does the marriage. The "wives" in such unions are not counted toward the maximum of four, and the offspring, if any, are often the exclusive responsibility of the woman.

Also known as a "pleasure marriage," Mutah was established within Islam by the Muslim prophet Mohammed himself as a way to reward his jihadists for services rendered to Allah. Although Mutah is sanctioned by the Koranic verse 4:24, the practice was later outlawed by the second Muslim Caliph, Omar I (634-644), who said he viewed temporary marriage as legalized adultery and fornication.

Because of the informal nature of temporary marriage, there are no official statistics to show how many of these unions there are in Britain. But Islamic scholars interviewed by the BBC say the practice is widespread, and anecdotal evidence suggests it is especially popular among the younger generation of Muslims in England and Wales.

In Luton, a heavily Islamized city situated 50 km (30 miles) north of London, temporary marriage has become so commonplace that it has been referred to as "wife swapping."

Some defenders of Islamic Sharia law, apparently eager to avoid another Muslim-related scandal in Britain, have sought to downplay the scope of the practice by claiming that temporary marriage is limited to only the Shia sect of Islam.

In an interview with the BBC, Khola Hasan, a Sunni Muslim and spokesperson for the Islamic Sharia Council of Britain, says temporary marriage is actually forbidden by Sharia law. "I have never come across a Sunni scholar, throughout history, who declares Mutah marriage to be halal [permissible]," Hasan claims.

Although Nikah al-Mutah is indeed practiced by Shia Muslims, Sunni Muslims engage in an even more libertine practice called Nikah al-Misyar (also Zawaj al-Misyar, meaning "traveler's marriage").

The Misyar is not a normal marriage in the sense that the "husband and wife" in this type of union normally live separately and meet only to fulfil their conjugal obligations. The man is usually already married and cannot afford another regular wife. In a Misyar, the man enters into what is essentially a temporary marriage in which the woman has limited rights.

Misyar marriages are often entered into by Sunni Muslim men who are living away from their regular wives in another country. It is also used by Muslim men who are on vacation and want to avoid incurring Islamic penalties for extramarital sex.

Critics of these informal marriages -- with men, both Sunni and Shia -- taking on multiple "wives" for a number of hours -- argue that they allow a Muslim man to have innumerable sexual partners (often underage girls), who are used as an "Islamic cover" for prostitution and the exploitation of women.

According to Khola Hasan, "There is no difference between Mutah marriage and prostitution. There is a time limit on the marriage, and the mahr [payment] given as a mandatory gift [from the man to the woman] is the equivalent as a payment to a prostitute."

The BBC documentary concludes that temporary marriage is often being used simply as a way of religiously legitimizing sex.

In an interview with the BBC, Omar Ali Grant, from London, and a convert to Shia Islam, says that has had around 13 temporary marriages but argues that he was just trying to find the right person to spend his life with. He concedes they could be used as a cover for premarital sex, but adds: "Sex is not haram [forbidden] per se. In Islam sex doesn't have negative connotations; it is not impure and is not dirty. What Islam is saying is sex has to be between consenting adults who are also responsible. Very often it is said that temporary marriage may amount to some prostitution, but it is not that. Prostitution does occur in certain areas of Muslim society, but then again prostitution happens everywhere."

A case of “shighar” marriage gained a lot of media attention lately. Part of the unfortunate arrangement has been overturned by the courts and an 11 year old child’s marriage to a 75 year old man has been ended.

Shighar marriages are “exchanges”, where one bride and her dowry are exchanged for another bride and her dowry. For example, a father will marry the daughter /sister of an acquaintance and in exchange the acquaintance will marry his daughter/sister. These marriages are Islamically illegal as the marriages are contingent not just on their own contracts, but also the implementation of another marriage contract (see my previous posts on marriages in Islam

These transactions are effectively a barter of children rather than being real marriages between consenting adults.

What is unsettling about the court ruling is that it is unclear if the ruling was based on the type of marriage (shighar) or on the fact that the minors involved were 11 and 16 years old.

This question comes to mind as not too long ago the marriage of an 8 year old to a 47 year old man was NOT overturned by Saudi courts [edition.cnn.com] news states the groom’s age as 58). This particular marriage was not a shighar marriage however it was done to pay off the father’s debt to his 47 (58 ) year old friend.[www.arabnews.com]

In this case the child, currently unaware that she is even married, will make the decision when she reaches puberty.

Since coming to KSA, my awareness of different types of marriages has increased considerably. Other than normal marriages and the oft-quoted multiple wives (polygyny) there are also misyar, misfar and shigar marriages.

Disclaimer: This post is about marriage as people or news have described it. This does not claim to describe the norm in KSA or any other country of the world

Normal- between one man and one woman
Polygyny- between one man and up to four women
Misyar- between one man and one woman with the woman giving up her right to financial support by the husband
Misfar- between one man and one woman done for the sole purpose of allowing the woman to travel outside the country
Shigar- one man marrying another man’s daughter or sister in exchange for the other man marrying his daughter or sister.
Urfi- an undocumented marriage between one man and one woman (not as common in KSA)

Misyar marriages are something mostly unknown to Americans, or most Westerners in general. They are problematic in many parts of the Middle East as well, with critics claiming that it’s merely a form of legalized prostitution. Two articles in today’s Arab News take a look at the practice.
