Just been going back over the early attempts of Ray's lawyers to defend him. This passage jumped out at me -- posted on Ray's site in January 2010

“If there were something inherently dangerous about the sweat lodge’s construction, Mr. Mercer bears the legal responsibility, not Mr. Ray. That Mr. Mercer may have had a motive to shift blame also has gone unreported [in the media].”

Those who saw the trial may recall Sergeant Barbaro's testimony. When he interviewed Ray shortly after the death lodge, Ray pathetically claimed that Ted Mercer, the fire keeper, had been in charge of the sweat lodge.

A few months afterwards, his attorneys were also trying to pin the deaths on Ted. (It's Luis Li's writing, incidentally; the rest of the paragraph finishes with the word "literally", in a way that only Li uses.)

What came out clearly in the evidence testimony is that JAR instructed, prior to construction, that the building be modified to lower the roof because he wanted a hotter environment than previous years. The Hamiltons both testified to that and to other modifications JAR insisted on. They complied because he was a big spender at Angel Valley but had decided to not host him again-- he was looking at other venues for the next event.

I notice the defense had the documents relating to Ray's mother sealed before they tabled them -- unlike when they tabled the list of participants of Ray's previous workshops, including name, address, phone no's, etc. They also displayed the social security number of one of the prosecution witnesses, and I few similar ruses, as I recall. Of course, that was all due to an "oversight", not part of an ongoing abusive power game with peoples private data and identity.
